SERVICE, TERMS OF SERVICE, YOU, SOFTWARE WorkMoniQ (references to “us”, “we”, or “our” being construed accordingly), the provider of WorkMoniq, offers its service (“Service”) to You, subject to the following Terms of Service (“TOS”). These TOS outline what you can expect from the Service and what we expect from You. “You”, “End User”, and “your” refer to the individual or entity that agrees to these TOS and subscribes to our Services. As an End User, you are granted a non-exclusive and non-transferable license (“License”) to use the accompanying binary software in machine-readable form (“Software”) to enable your use of the Service.

By signing up for the Service, you agree to the terms and conditions of these TOS. 

REGISTRATION OBLIGATIONS To access the Service, you must sign up and provide true, accurate, and complete information. You are responsible for maintaining and updating this information. If you provide inaccurate or incomplete information, we reserve the right to suspend or terminate your use of the Service. You are responsible for safeguarding your login credentials and must notify us immediately of any unauthorized use of your account or security breaches. 

FEES Your right to use the Service is subject to the payment of applicable fees. Fees may be paid using a credit card or other payment methods as specified by us. We reserve the right to change our pricing and billing methods at our discretion. 

PROHIBITED USE You agree not to: 

•  Violate any local, state, or national laws while using the Service. 
•  Collect or process data of other users except for monitoring employee efficiency and contractual obligations, ensuring compliance with data protection laws  or applicable national regulations. 
•  Interfere with the proper functioning of the Service using unauthorized software or tools. 
•  Overload the Service infrastructure with unreasonable demands. 
•  Use the Service in any unauthorized manner outlined in the TOS. 
•  Reproduce, resell, or exploit any portion of the Service for commercial purposes. 

OWNERSHIP AND RESTRICTIONS The License granted in these TOS does not transfer ownership rights. We retain all intellectual property rights to the Software. You must not copy, modify, distribute, or publicly display any content from the Service without our written permission. 

PRIVACY POLICY Your registration and usage information are governed by a separate Privacy Policy, which outlines how we collect, store, and use your data. 

LIMITED WARRANTY AND DISCLAIMER OF WARRANTY The Software is provided  except for the features explicitly listed in the pricing plan. If the Software fails to perform as described, your sole remedy is a repair, replacement, or refund of the applicable fees. 

 All other warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are excluded to the maximum extent allowed by law. 

LIMITATION OF LIABILITY We are not liable for lost revenue, profit, or data, or for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability under these TOS will not exceed the amount paid by You for the Service. 

TERMINATION You may cancel the Service at any time. Termination of the Service is at your discretion, provided that you have met your TOS obligations and paid all applicable fees. 

 This License will terminate immediately if You fail to comply with any provision of these TOS. 

 Upon termination, the Service will be disabled, and any fees paid are non-refundable. 

GOVERNING LAW AND JURISDICTION These TOS are governed by and construed in accordance with the laws of Nepal. Any disputes will be subject to the exclusive jurisdiction of the competent courts in Nepal. 

GENERAL INFORMATION We may provide notices via email, regular mail, or conspicuous notifications within the Service. We reserve the right to modify or replace these TOS at our discretion. If changes are material, we will provide at least 30 days notice before the new terms take effect. 

By continuing to use the Service after changes are made, You agree to the updated TOS.
